Consignment Agreement
Last updated: October 8, 2026
A transparent framework for selling sports cards, Pokemon and autographed memorabilia on your behalf.
Consignment begins only after both parties accept these terms and a completed item-specific schedule in writing.
1. Parties and acceptance
The property owner or authorized representative is the Consignor; Flagship Collectibles is the Consignee. This framework becomes a transaction agreement only when both parties accept it in writing together with a completed item schedule and any amendments. Viewing this page or submitting an inquiry does not create a consignment.
The schedule identifies the parties, items, commission, expenses, pricing authority, channels, duration, transport and settlement arrangements. Do not deliver property before written acceptance. Item-specific accepted terms control over conflicting general provisions.
2. Ownership and authority
The Consignor represents that they own the items or have documented legal authority to consign them, that the property is not stolen or subject to undisclosed liens, and that sale does not violate others' rights. Estate representatives must provide authority when reasonably requested.
Disclose known alterations, restoration, authenticity concerns, counterfeit status, material damage and provenance. Acceptance for review does not guarantee authenticity or a professional grade. We may decline or pause an item if ownership or authenticity is reasonably questioned.
3. Inventory and intake
Identify each item or agreed lot by description, quantity, identifiers or grading certification, condition, defects and reference photographs. Both parties should confirm inventory and intake condition, including discrepancies identified after receipt.
Custody begins upon confirmed delivery or documented handover. Agree packing, delivery tracking, declared values, insurance and transport responsibility before moving property. This page does not establish a carrier or insurance coverage amount.
4. Services and selling authority
The Consignor authorizes photography, descriptions, listings, sale arrangements and shipping for scheduled items through agreed channels. We handle pictures, listings and shipping within that scope. Grading, authentication, restoration, estate cleanout or other additional services require written approval and cost authorization.
The schedule must state fixed-price or auction format, reserves/minimum amounts, offer acceptance authority and approval requirements for price reductions. Any exclusivity must be expressly agreed, not presumed. Photographs and descriptions may be used to market and document the sale.
5. Commission and expenses
Commission varies by item and is capped at 30%. The exact rate and calculation basis must be recorded in the accepted schedule, including treatment of taxes, buyer-paid shipping and refunds.
If marketplace/payment fees, shipping, insurance, supplies, grading or other expenses are separately payable by the Consignor, itemize them or agree a calculation and authorization limit in advance. State which costs the commission includes to avoid double-charging. An inquiry does not authorize undisclosed charges.
Settlement records show gross proceeds, agreed commission, approved expenses, adjustments and net payout. An undisclosed fee must not be substituted for the commission cap.
6. Custody, risk and insurance
Ownership remains with the Consignor until buyer transfer under the accepted sale terms. We use reasonable care for property in confirmed custody. The schedule must address storage, transport risk, insurance if any, insured values and claim responsibility; this page does not create blanket coverage.
The parties will promptly share records and cooperate on loss, damage and carrier/insurance investigations. Responsibility follows the accepted agreement and applicable law, not an unsupported promise of replacement at an estimated market value.
7. Sales, buyer returns and reversals
Sales follow the agreed listing and marketplace rules, including buyer protection and applicable returns. Nonpayment, returns, chargebacks and authenticity disputes may reverse a sale. Estimates are not guaranteed prices or sale dates; auctions can generate lower proceeds than expected.
Material reversals and adjustments must be documented and communicated. If proceeds were already paid, responsibility for a valid reversal or related expense follows the accepted terms and applicable law. No blanket no-returns rule or unlimited reimbursement obligation is implied here.
8. Accounting and payout
The schedule must establish payout method, settlement trigger and deadline, with treatment of payment clearance and unresolved disputes. An inquiry alone establishes no payout date. Payment goes to the Consignor or an expressly authorized payee.
We provide an itemized accounting of completed sales and deductions. Raise discrepancies promptly with supporting records. Each party remains responsible for its own taxes and legally required reporting; seek qualified tax advice for specific circumstances.
9. Duration, withdrawal and unsold items
Agree the start, duration, termination conditions and unsold-item arrangements in the schedule. Ending consignment does not automatically cancel an active auction, accepted buyer agreement or marketplace obligation.
Withdrawal expenses or reimbursement for approved work require advance agreement; no cancellation penalty is implied. Agree the return recipient, transport, insurance and costs in writing. Items do not become our property merely because the term ends or collection is delayed; applicable unclaimed-property law must be followed.
10. Communication, records and privacy
Both parties should retain the accepted agreement, schedule, inventory, approvals and settlement records. Record material changes and maintain current contact details. Necessary information may be shared with agreed buyers, marketplaces, carriers and grading services under our Privacy Policy. Public listings should not unnecessarily expose the Consignor's personal details.
11. Disputes and legal protections
Contact us promptly so the parties can attempt good-faith resolution. Maryland law applies except where mandatory law requires otherwise; courts with lawful jurisdiction may hear disputes. This framework does not require arbitration or waive non-waivable rights.
No provision excludes liability that cannot lawfully be excluded. Changes require mutual written acceptance. If a provision is unenforceable, the rest continues to the extent permitted by law. No price, grade or completion date is guaranteed unless expressly accepted in writing.
12. Required schedule before signing
Before acceptance, record both parties' legal contracting details and authority; dated inventory and condition records; commission rate and basis; included and separately approved costs; pricing instructions, reserves and channels; custody, transport and insurance; duration and withdrawal; return/dispute allocation; payout method and deadline; and signatures or other documented acceptance from both parties.
Contact us to prepare this item-specific schedule. The website does not collect a signature or automatically bind a consignment through a form submission.
